Harassment of Advocate demanded official’s Arrest

ADVOCATE SELF IMMOLATES ALLEGING HARASSMENT BY SDM, SHO: HCBA DEMANDS OFFICIAL'S ARREST AND SUSPENSION

A Sikar based 40 year old advocate Hansraj Malwiya, died in a recent event by setting himself on fire inside the sub-Divisional Magistrate’s office. In his suicide note, the advocate stated that he was being harassed by the Sub-Divisional Magistrate Rakesh Kumar and for bribes for every hearing of revenue related cases in the Court. Also, it was mentioned in the Suicide Note that he was being threatened by the Khandela SHO Ghasiram Meena for speaking out against the SDM Rakesh Kumar.

It was stated by the police that Advocate Hansraj Malwiya poured petrol on himself on 9th June before he self- immolated. After Setting himself on fire, he entered the chamber of Khandela SDO Rakesh Kumar and tried to touch him, who got some injuries but managed to free himself. Malwiya was declared dead after he was taken to Jaipur as he was 70% burnt.

After the incident the Rajasthan High Court Bar Association condemned the incident and demanded that the State Government shall suspend and arrest the concerned officers with immediate effect.

Later, protests were held in several districts of Rajasthan, who blocked roads and boycotted work. The police stated that the SDO and SHO have been booked abetment to suicide under Section 306 of the IPC. Also, FIR was registered on the complaint of the SDO against Malwiya including attempt to murder under Section 307 of the IPC, as Malwiya also dragged the SDO while he set himself on fire.

Lawyers and public representatives have started an indefinite dharna outside the office of the SDM in Khandela(where the incident took place) regarding their demands, i.e., a five point demand letter has been presented. The protests are going on with the dead body of the Lawyer Malwiya, which has been kept in deep freeze, the family is demanding the SDM and SHO to be arrested immediately as well as other demands to be fulfilled, until then they won’t take the body to cremate.

The other demands include that a CBI inquiry should be conducted into the matter. One member of the victim’s family was given a government job. Also a compensation of rupees 2 crores was given to the family of the victim. All the matters of the SDM office should be investigated by a civil officer.

Allegations on the Administration:

The brother of the deceased alleged that the police deliberately did not take the deceased to the hospital, the ambulance was moving slowly on the way so that the statement of the deceased could not be taken.

Rounds of talks: Failed

The administration had conducted three rounds of talks till now, however, all the talks have failed. The protestors are adamant in their demands and are asking for an immediate arrest of the accused. With the presence of Bhunesh Sharma, President of the High Court Bar Association, it could be assumed that the matter is not going to be solved so easily and all the agitation will be continue untill the demands are not met.
