Trademark is a symbol or mark used to define or segregate one business from the other business. Trademarks can be owned either by an individual or by any legal entity. It is basically the protection of your brand from other similar kinds of business.

Costs:

Registering Trademark involves hefty costs and lengthy procedures. Cost is segregated into 2 different categories i.e. the government fee and professional fee. Once the Trademark is accepted and published in the official journal, it is open for public opposition for 4 months by the third party. In the event, it is opposed, You need to go through a different procedure for which there would be additional charges depending on the approach you take. 

In the event, the applicant is a start-up having a DIPP certificate, professional charges will not be applicable but the official fees will be INR 5000/-.

Legal fees for Objection:

You need to hire a lawyer if the reason for objection is that there is already a name and symbol existing for the similar business.

Legal fees for Opposition:

Opposition is raised by 3rd parties and objection is raised by the government. Other businesses can put allegations against you if you are using similar logos and symbols.It can be considered violation of intellectual property and approx charges for the same can be 8,000/- to -10,000/- approx.

Status Post Cost is Paid:

After paying the cost, it is always advisable to check the status of application:

  1. Registered: If the application shows registered, it means the application is approved  and Trademark is registered on the name of applicant.
  2. Abandoned: It means that the applicant has failed to respond to the registrar within stipulated time.
  3. Marked for Exam: It means application is submitted and reached the 3rd step of procedure for examination report.
  4. Objected: It means the registrar wants some clarification related to registration and objection has been raised against it. Proper reply is being asked from you via examination report.
  5. Refused:  It means the application is refused based on the applicant’s response.
  6. Opposed: It means the application is opposed by any third party after publication in Trademark Journal.
