Important Features Of The Factories Act, 1948:
- In India, the Factories Act, 1881 was originally established to fulfill certain proposals for the protection of children and for the well-being and safety of workers.
- The Act is faultless in all aspects and meets several requirements of international conventions such as the Code of Industrial Hygiene and the Periodic Examination of Young Persons.
Main Objectives Of The Factories Act –
- To protect workers from working long hours of work.

- Regular visits to industrial sites by industrial examiners to monitor health and safety arrangements.

- If an employee has to work standing, then the method of sitting for short rest should be adopted.

Advantages In Case Of Large Factories:
- Childcare or, preschools are to be implemented if 30 or more women workers are engaged.
- Safety standards.
- Working hours.
- Pay wages:
- Overtime wages are 2X times the rate of wages payable.
- Overtime should not exceed 60 hours in a week and total overtime hours in a section should not exceed 50. Records of overtime must be reported.
Rights Of Working Women In Factories –
- Women should have separate washrooms and bathrooms with doors.
- If a company has more than 30 female employees, the company should set up a Creche for the employee’s children.
- Women cannot be made to carry a weight greater than a given and.
- Women cannot be forced to clean or oil any moving engine.
- Women cannot be forced to work more than 48 hours a week.
- Women must get one day off a week.
- Women cannot be made to serve more than 5 hours on a compass.
- Women cannot be forced to work only between 6 am and 7 pm.
- The state government can make exceptions to any industry or group or class of companies, but no woman can be authorized to work from 10 pm to 5 am.
- Shifts can only change weekly or after other weekends and not within.
Night Shift For Women –
- Recommendations have been made to reform the Factories Act to allow night shifts for women workers.
- The administration has resolved to amend section 66 of the Factories Act, 1948 so that women workers can be given commission between 7:00 pm and 6:00 am.
- The employer has to assure professional safety and adequate strength to the women workers.
- For contravention of pre-requisites of the Act or rules- Imprisonment up to 2 years or fine up to Rs. 1,00,000 or both.
- Conflict causing death or grievous bodily injury- Fine of not less than Rs. 25,000 in case of death and a minimum of Rs. 5000 in case of serious injuries.
- Regarding safety or unsafe operation in violation of Chapter IV.
- The Factories Act works with a prime objective to protect workers engaged in factories related to industrial and occupational accidents.
