In Order to protect the rights of senior citizens, Indian law has different provisions for their welfare and maintenance. Section 20(3) of the Hindu Adoption and Maintenance Act outlines the obligation of the person to maintain his or her parents whenever they are capable of maintaining themselves; the same thing is mentioned under the Muslim law, which is that each person is bound to take care of their parents as per their financial capabilities.
In the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, the following provisions are in place to safeguard the interests of senior citizens:
Maintenance
The act provides for legal provisions to ensure that children or relatives who have the means to support senior citizens are legally bound to provide them with maintenance and basic amenities.
Protection of Life and Property
The act makes it a legal obligation for children or relatives to protect the life and property of senior citizens. Any abuse or neglect can lead to legal action.
Medical Care
The act emphasizes the need for medical care for senior citizens and allows for the establishment of old age homes, hospitals, and other facilities to cater to their healthcare needs.
Reservation of Seats
The act includes provisions for the reservation of seats for senior citizens on public transport, including buses and trains.
Grievance Redressal
The act provides for the establishment of maintenance tribunals at the district level to address disputes related to the maintenance and welfare of senior citizens.
