What happens when you get Legal Notice?

The person sending the legal notice notifies the person who receives such notice about sender’s intention of taking any legal proceeding against him later, the sender makes aware the recipient about any future legal proceeding, we can also say Legal Notice as a warning  to the person who receives such notices, if the person receiving such notice don’t full fill the conditions that are mentioned in the notice then the person sending such notice will or can take the matter before the court. We can also say that sending a legal notice is a kind of tool which reduces the cost of litigation and reduces time as well.

The Legal Notice is used in certain many places some of them are as follows:

  1. Employment matters: Any employee who faces any issue or any disturbance in payment of salary can send legal notice to settlement.
  2. Money Recovered: A person can send a legal notice for the recovery of his/her money.
  3. Cheque Bounce: when any person cheque is dishonoured, then the aggrieved person can send legal notice to recover the payment as per Negotiable Instrument act.
  4. Dispute related to property: There are certain disputes such as partition, succession, or eviction of any property the person can use legal notice in these circumstances.
  5. Consumer cases: When any person buys or sells the good or any kind of service which is a faulty product or services, then the aggrieved person can send legal notice to avoid such default

Usually we send legal notices in Civil matters. In criminal matters legal notice is not used, in criminal cases the aion is instituted by the state against the person committing any criminal offence.

The notice needs reply so before replying the notice cross examine all the documents, facts and agreement and go through all the facts and agreement and if you get a valid reason to prove do mention all those proof in reply and before sending the reply one should keep in mind that person sending the reply should send the reply in language in which he/she is comfortable, if the person sending the reply face any issue or consequences he/she must hire a lawyer or legal experts who would guide them in sending such replies, one should also keep in mind that the reply must not contain any abusive or foul language or any irrelevant content. And the hard copy as well as the soft copy of the reply in the form of mail and Whatsapp should be sent to the person by whom the legal notice has been sent and also keep in mind to keep one copy of reply to yourself.
