What to do if your partner renounces all the worldly affairs to embrace their religion?

In a marriage, when you take oath to be there for someone, you should obey that. A religion is a crucial part of one’s life & it should facilitate one’s married life. But some cases have come before the Law where some people have renounced all the worldly affairs including their married life, their personal relations, even their children to embrace their religion.

For years, their family didn’t hear about them. They didn’t have any source of income. Such people leave all their responsibilities behind in order to embrace their religion. Here, the aggrieved is his family.

Sometimes the wife of the person is a home maker & their children are dependent on their mother for everything. In such cases, trouble occurs. Sustaining a whole family without any proper source of income is a task in itself.

Due to rise in such cases, this was also made a ground to grant divorce to the aggrieved.  According to section 13 (1), a spouse is entitled to file a petition for divorce if his/her partner renounces all the worldly affairs & breaks all marital, societal ties & move out leaving behind his family without any financial support willingly, to embrace his religion.

But the aggrieved has to prove that they have been living separately for at least 7 years & there has been no communication between her & the spouse in all these years .

The defendant in this case can counter back by proving that he has been there for the family. If the defendant is financially or emotionally supporting the family & is not physiccally living together, then it would not be considered as renunciation.
