What should I do after the accused filed a case?

My car met with an accident. The accused was deadly drunk and hit my car from the opposite side. I have tried to lodge a case but by request of their relatives I did not. Police have also refused to receive the complaint. I claimed the Insurance company to repair my car by giving undertaking that to not be liable in this case. Now the accused has lodged a case against me and Insurance Company for a claim. Now what I have to do. Please suggest.
