Can you appeal to Deputy Commissioner for EWS rejection?

I applied for EWS in Jammu and my EWS was rejected, The reason Tehsildar has given is that my plot size is more than the limit of 900 sq ft . Our plot size is 1350 sq ft. We don't have any agricultural land of 5 acres, and our income is less than 8 LPA. our plot is in our GrandMother's Name and she has 7 childrens,Our property has not been distributed yet between my father's, brother, and sisters. Currently, my family is living in our plot and my father’s brother is living separately. I met with the Tehsildar and told him, regarding the DOPT orders of 19th Sep 2022 https://doptcirculars.nic.in/OM/ViewOM.aspx?id=158&headid=6, where it is clearly mentioned that grandparents are not of family and If the property of Grandparents is not distributed between parents, the property will not be counted. I showed all the Notices to the Tehsildar. But, he did not listen to me. So, Should I go to the Deputy Commissioner of Jammu or any court case will help me?
