What legal action can be taken if wife refuses to return home?

Marriage was solemnized in 2016, which is about 8 years ago. After about 4 years of marriage, following some disputes, my wife went to her father's house and returned 3 months later after the dispute was resolved between both sides of the family. Now, she has left again about 2 months ago and is residing with her parents. I have sent her a message asking her to come back and settle the problem, but there has been no response or communication from her side. Please advise on what action should be taken next so that the problem can be resolved amicably.

First of all, try to talk through a mutual friend or family member to convey interest in discussing the issues. Alternatively, you could suggest professional counseling or mediation to sort out underlying disputes and improve communication. If she does not respond, consider filing for restitution of conjugal rights under Section 9 of the Hindu Marriage Act, which seeks to compel her to return and resume marital relations. Another critical thing here is to document all communications and attempts at reconciliation, as such records can be of great value if things push to the courtroom. Consulting a family lawyer might provide special legal counsel based upon your unique circumstances.

In your own case, apply for Restitution of Conjugal Rights under Section 9 of the Hindu Marriage Act, 1955. This court remedy enables you to seek a formal request for your wife to resume cohabitation if she has deserted you without any justified cause. Presenting the petition proves that you are willing to reconcile with her and persuade her to return to resolve the issues. If she doesn't respond, the court may suggest mediation so that you two can resolve your disputes amicably. You should always maintain respectful communication with her, as any indication that you or she genuinely intend to settle the issue will help your case.

Sir, if you want to solve the matter amicably you should first try formal communication through a legal notice and propose counseling or mediation. If these efforts does not work then you can file for restitution of conjugal rights or consider a divorce if reconciliation is not possible. It is advised to consult an expert lawyer who will assist you in understanding your rights. For further legal assistance contact us on our helpline number.
