Can I get a refund from a scam interior company?

I had signed up with an interior company. After paying 60%, I spotted red flags (workers not coming to the site, office shut down, phones switched off, design phase not completed). Now, the company is asking for the last payment (40%) so they can dispatch my furniture from the factory. I did research and realised that it is a scam company and came across >20 aggrieved clients. The company has been taking money under different names, dodged their calls after receiving the last instalment and not completed any projects. I obviously refused to pay the company and claimed a refund. What can I do?

Under the Consumer Protection Act, 2019, and relevant provisions of the Indian Penal Code (IPC), including Section 420 (cheating and dishonestly inducing delivery of property), you have the right to seek legal recourse against the company for fraud and deficiency in services. You can file a complaint with the Consumer Disputes Redressal Commission for a refund and compensation for financial loss and mental distress. Additionally, lodge a criminal complaint (FIR) with the local police against the company for fraudulent practices. Preserve all communication records, payment receipts, and evidence of the scam to strengthen your case.

You can lodge a criminal complaint for fraud and breach of trust under BNS against the company and its directors at your local police station or lodge an FIR online. Besides, file a complaint with the Consumer Forum under the Consumer Protection Act, 2019, demanding a refund and compensation for mental harassment and financial loss. You can gather evidence of the agreement, payment receipts, and communication records to prove your claim. In addition, you can alert various consumer protection and trade agencies to further amplify pressure and act to stop fraudulent activities from a firm.
