Can I get a refund if the product is defective?

I ordered a neckband worth 849 from the Boat official website. The sound quality is not good. Now I want a refund for the neckband, but the website is only offering a replacement. My question is, can I get a refund? Is it mandatory to provide a refund?

Whether you can get a refund depends on Boat’s return policy. If their policy only allows a replacement for defective products, they are not legally required to provide a refund unless the product is unusable or violates consumer protection laws. You can file a complaint under the Consumer Protection Act, 2019, if the product has a major defect and the company refuses a refund. If the issue persists, you may approach the Consumer Disputes Redressal Commission for resolution.

You should first see the return policy of the website and if it offers a return or replacement in case of any defect or if not satisfied with the product but if it doesnot work as per its return policy you can move to the district consumer court and file a complaint against the dealer.

As per Indian consumer protection laws, if a product are defective or do not meet expectations, you are entitled to a refund. If the product is faulty and the website only offers a replacement, you can file a complaint with the Consumer Forum. Companies are required to provide a remedy (refund, replacement, or repair) under the Consumer Protection Act. For further legal assistance contact us on our helpline number.
