Will consumer forum accept maintenance dispute case with compound interest?
I have a Maintenance charges dispute with society they are revising billing and not accepting their own receipt, neither were sending breakup from last 7-8 years. and now asking for a compound interest of 2% PM. would my case be accepted in consumer forum, as civil suit takes a lot of time

Yes, you can file a case in the Consumer Forum if the housing society's actions amount to a "deficiency in service" under the Consumer Protection Act, 2019. Since they are not providing a proper billing breakup, denying previous receipts and charging an unfair compound interest of 2% per month, it may be considered an unfair trade practice. The Consumer Forum is generally faster than civil courts and can help resolve disputes related to improper billing and arbitrary charges. However, if the issue involves complex property rights or legal ownership matters, a civil suit may still be necessary.

Sir, you can file a complaint in the consumer forum for improper billing and unjust compound interest. Gather documents like receipts, communication, and billing statements as evidence. If the society refuses to cooperate, you can also approach the registrar of societies or send a legal notice demanding proper breakdown and removal of interest charges. The consumer forum is faster than a civil suit and is suitable for resolving such disputes. For further legal assistance contact us on our helpline number.
