Your husband, however, cannot legally produce any recorded conversations against you, since these are contraventions of your right to privacy under Article 21 of the Indian Constitution. Such unauthorised recordings of any individual's conversations, for example, have been ruled to violate personal dignity and confidentiality. Likewise, installing CCTV cameras without seeking permission may be challenged by an individual as an infringement on privacy. The courts tend to hold individual rights in marriage supreme, with the fact that marital trust does not constitute a right to spy or record without consent. Consequently, the recordings and CCTV footage will probably be inadmissible in any legal proceedings against you.

Generally speaking, it is held in India that the recording of conversations without the other party's consent constitutes a violation of rights pertaining to privacy. Catena of judgments in the Punjab and Haryana High Court have held that evidence in the form of recording cannot be permitted in family law cases as such recording has been held violative of the right to privacy under Article 21 of the Constitution. Similarly, CCTV footage installed without consent may also be challenged on privacy grounds. Your husband, therefore, cannot use these recordings against you in court.
