Am I eligible for pension arrears under Supreme Court order for family?

My brother died in 1998 during his service period. He was working in a Regional Rural Bank and was unmarried, and we have no parents. I was nominated in the PF, and I have been receiving the pension since his demise. However, recently, the Supreme Court ordered RRBs to pay pension to all retirees and family pensioners with arrears. Will I receive a pension from the RRB? What will happen to my EPS '95 pension after this recent order? One of the bank representatives unofficially told me that I will not receive any pension. Kindly provide me with accurate information regarding this issue. Thank you.

Since you have been receiving a pension as a nominee from your brother's service in a Regional Rural Bank (RRB), you may be eligible for additional benefits following the recent Supreme Court ruling. This ruling requires RRBs to pay pensions to retirees and family pensioners with arrears. You should contact the RRB to inquire about any potential arrears or additional payments you may receive. Regarding your Employees' Pension Scheme (EPS) '95 pension, if your brother's service qualifies, you might also be entitled to an upgraded pension based on the Supreme Court's decision. It’s essential to reach out to both the RRB and the EPFO for accurate information and to ensure you receive any benefits owed to you.

Yes, you should be eligible to receive a pension from the Regional Rural Bank (RRB) following the Supreme Court's recent order. Since you were nominated for the provident fund and have been receiving a pension, you may also qualify for arrears due to the new ruling. Regarding your EPS '95 pension, it will depend on specific eligibility criteria set by the EPFO after the ruling. The unofficial statement from the bank representative may not reflect the legal position, so consider seeking formal confirmation from the RRB or EPFO directly for accurate information.

Sir, you are likely entitled to receive the pension and arrears from the Regional Rural Bank (RRB), as per the Supreme Court's ruling requiring RRBs to pay pension to retirees and family pensioners. Since you have been receiving your brother's pension, the arrears should be applicable to you under the EPS '95 scheme. For further legal assistance contact us on our helpline number.
