Can I apply for a government job as an OBC candidate?

I am an OBC candidate by birth, but I married a Group B spouse. Am I still considered an OBC candidate? Also, if my spouse’s income crosses the OBC income threshold of Rs. 8 lakh, can I still apply as an OBC candidate for a government job?

Yes, you can apply as an OBC candidate because your OBC status is determined by your birth and not by marriage. The "creamy layer" rule applies to your parents' income, not your spouse's income, for government job reservations. If your parents' income is below Rs. 8 lakh (excluding salaries and agricultural income), you remain eligible for OBC reservation. Your spouse’s income does not affect your OBC status for job applications.

There is no provision that states that for the consideration of OBC status, the spouse's income is taken into consideration; only the income of parents is taken into consideration for the determination of OBC status. Yes, you can apply as an OBC candidate if your parental income satisfies the conditions given for the eligibility as an OBC.

Your OBC status remains intact even after marrying a Group B spouse. The income limit of Rs. 8 lakh applies to the EWS category and does not affect your eligibility as an OBC candidate for government jobs. If your spouse's income exceeds the EWS limit, it does not change your OBC status. To ensure eligibility, review government guidelines or consult a lawyer for specific advice based on the job you're applying for. For further legal assistance contact us on our helpline number.
