मैं अपना कोर्ट केस जीतने के बाद मुआवज़ा कैसे प्राप्त कर सकता हूँ?

3(1)(i), (ii) & (iii) read with Rule 4(I), 4(5) & 4(9) and 25 of GI (CDA) Rule 1975 ke antargat 2021 mein terminate kiya gaya tha. Chandigarh High Court mein case CWP 19258 petition under Articles 226/227 dalayi gayi thi September 2021 mein, aur court ka decision hamare haq mein aaya tha (Annexure P-4) 10-05-2021 ko. Lekin abhi tak koi muawaza nahi mila hai. Agar hum company se ex-employee ke account ke status ki detail mangte hain, to koi jawab nahi milta. 3 baar RTI bhi laga chuke hain, lekin koi jawab nahi diya gaya. Mera aap se anurodh hai ki aap meri problem ka koi solution nikaale.

Although there is a favorable judgment in this case by the Chandigarh High Court, one has to consider making a contempt application before the concerned officers on the failure of the officials concerned to comply with the directions of the court. Additionally, for the purpose of discussing the prospects of giving an effective shape to the decree of the court and damages suffered due to delay, consult lawyers. Send RTI requests and have them escalated to higher officers or the State Information Commission if the responses are not coming. You may also use the various redressal mechanisms available in the government to lodge your complaint against these officers and seek your rightful compensation early enough.

You may also move the Chandigarh High Court with a contempt petition if its previous orders relating to compensation are not complied with. The court has already ruled that the benefits cannot be deprived from employees by backdating the date of termination (CWP 19258). You can also seek judicial review under Article 226 for vindication of your rights. If RTI responses are not redressed, raise the issue before higher authorities or lodge complaints before State Information Commission for appropriate action.
