Can I legally claim my share of my father's GPF funds?

My father was a West Bengal state government employee who ceased work following my mother’s death in 2012. At that time, he did not receive any pension or benefits. After 10 years, his General Provident Fund (GPF) amount has been released, which is currently being held by my elder brother. We have filed a case in the State Administrative Tribunal, but my brother is attempting to claim the entire amount for himself. It is important to note that while he provides a minimal amount for my father’s attendance, I cover other expenses, including food and medicines. In this situation, can I take any legal action to ensure a proper division of these funds, particularly for any future amounts? Thank you.

Sir, as you have already filed a case in the State Administrative Tribunal so you can request the court to intervene for a fair division of the GPF amount. It is advised to consult an expert lawyer who will assist you to file a petition that outlines your contributions and the need for equitable distribution.
