Can you file a police complaint against the person for using your property without permission?

Hi, I'm X, NRI. My dad rented out my commercial space based on POA. The tenant didn't pay rent for the last 6 months and keep on asking time to vacate. We asked him to vacate by May 2024 and he agreed to vacate by Aug 31, 2024 in written statement. As per our rental agreement, we have a condition stated that on breach of rental conditions or termination of rental agreement, tenant lose all his rights on the tenanted premises immediately without any notice period. Now, what can we do? Can I file police complaint for using my property without my permission and/or locking out our premises and preventing us from using it? Please advice.

Sir, you can file a complaint followed by a legal notice to be issued for vacating your property. However, if the tenant refuses to vacate, which makes you eligible to file an eviction suit in court of law. For further legal assistance contact us on our helpline number.
