How to legally deal with threat and harassment ?
Hello Sir, someone has been calling both my father and me repeatedly, asking us to refund money that my brother took, which we are not aware of. He never consulted us before receiving this money. What should we do? I am feeling very depressed and unable to focus on my work.
In this case, write to the caller (preferably through email or message) that you and your father have no liability for the debts or agreements your brother so singly undertakes, since neither of you was party to nor ever informed of those liabilities. Legally, financial obligations are personal unless others have guaranteed them under Indian Contract Act, 1872. If these calls are persisting and troubling, file a police complaint for harassment and intimidation under Section 503 (criminal intimidation) and Section 506 (punishment for criminal intimidation) of the Indian Penal Code. This shall suffice to put an end to such harassment and save the mental health.
Report the threat to law enforcement. A PHONED THREAT is a threat received by telephone. You should try to get as much information on the caller and the threat as possible, unless the threat is nearby or may imminently harm you or others. Remain calm and do not hang up.
Sir, firstly you should communicate your brother and clarify the matter. If the calls are harassing then you must cease the contact and consider filing a police complaint with the help of an expert lawyer who will assist you in understanding your rights and obligations.
