हमारे घर सेआने जाने का रास्ता खसरा नंबर किसका मैं सह खातेदार हूं जिसका कानूनी तरीके से 3 वे भाग का हक्केदार हूं एक मेरा पटीदार जो 1/3 भाग का हक्केदार है वह पूरे चक को कब्जा करके हमारा रास्ता और हमारा हिस्सा कब्जा कर लिया है जिससे हमारा आवागमन बंद हो गया है तत्काल रास्ता खुलवाने के लिए क्या करें?

If that is the only way to access your property, you can file a complaint under Section 13 of the Indian Easements Act, 1882, which deals with the Easement of Necessity if that is the only way to access your property. And for the encroachment upon your property, you can file a civil suit under section 26, order VII, of the CPC.

Direct communication may result in a mutual agreement. If this does not work, then consider sending a legal notice demanding the removal of the obstruction and restoration of access. You can file a partition suit in civil court if necessary for legal division of the property, exercising your right to access it. You can also obtain an injunction from the court to put a stop to the obstruction when the case is underway. It would be advisable, too, to go and seek the right counsel and advocacy from a property lawyer.
