Who can I sue when company fails investment promises?
The company has not paid the promised interest and maturity amount for several months. Some affected investors have filed a case, which is currently ongoing in the TANPID Court in Madurai. The EOW (Economic Offences Wing) has not filed a charge of cheating because the company claims it will settle under the 5A settlement for the complainant investors, with the intention of retrieving the forfeited company assets through the court. I have not filed a complaint yet, as the company has promised an out-of-court settlement—but only verbally. In this context, can I file a case against the prime agent who personally received the investment amount (both in cash and through bank transfers) and gave me bonds for the amount invested. He has accumulated personal wealth and assets from these dealings. Can I file a case against him separately and claim my money back from the prime agent? Kindly advise, sir.

Yes, you can file a case against the agent if he took money from you and gave bonds. You can take both legal and police action to recover your amount. Even if the company promised settlement, you are still entitled to take action if you have not received your money yet. It is advised to consult an expert lawyer who will assist you with the best course of action. For further legal assistance contact us on our helpline number.
