Can defendant file CPC 39(2A) after temporary injunction appeal rejection?

The plaintiff's temporary injunction appeal was rejected, but the plaintiff is still interfering with the construction of the dependent. Is there a previous court order available in which the defendant filed a CPC 39(2A) against the plaintiff?
