Can I file a criminal case against my son for fraud?

My son created a will in his favor as my sister's grandson. He himself signed as a witness for an unknown person on blank stamp papers that belonged to my brother. The estate is currently in his possession, and at the time the will was created, the legal heirs were my sister and me. He has taken control of the estate and even secured a home loan from SBI without a valid title. The estate is still in my late father's name, which has been in place since 1937. Can I file a criminal case against him?

Yes, you can file a criminal case against him for fraud, forgery, and misrepresentation under IPC sections like 420 (cheating), 467, and 468 (forgery). Since the estate is still in your late father's name and the will appears fraudulent, you can also challenge his possession in a civil court. Additionally, you may file a complaint with the bank regarding the home loan obtained without a valid title.

You can file a case of fraud and forgery against your son if the will was made fraudulently and he has taken illegal possession of the property. It is advised to consult an expert lawyer who will assist you to challenge the will in court of law. For further legal assistance contact us on our helpline number.
