What should I do if my father denies selling inherited property?

Hi, My mother died few years back. Now me and my brother and my father are the legal heir of my mother's property. My mother has a house in Bangalore. My father is well settled and getting an income of 70k per month. My brother also well settled getting a good income. And I don't have job or any income source. Now if I want to sell the property, my father is demanding more share of that property and not allowing us to sell. If I file a partition case on that house, it's going to take long time to get the judgments it seems. Kindly suggest what should I do?

Start by negotiating with your father and brother in order to come to an fair decision on selling. In case the negotiations fail, mediation by a neutral third party may be considered in reaching an agreement. You might take it to court and have a suit for partition filed so you could enforce your rights as a legal heir. However long this process may take, it is indeed a lawful course of action to remedy whatever dispute there may be pertaining to property ownership. It would be best advised by an attorney specializing in this field to guide you along this process.

The best approach to that issue of selling your mom's property in Bangalore would most probably start with a negotiating approach trying to reach as much consensus as possible with your dad and brother regarding selling the property. In case negotiations collapse, then mediation with an outsider, who is an intermediary may ease the discussion, eventually arriving at a mutually favorable agreement. If all these do not work, then you may have to file a partition suit in court, which legally establishes your rights to the property. This is, however a time-consuming process, but it is one of the available ways of resolving disputes over property ownership. A lawyer specializing in property disputes should be consulted to effectively navigate the legal process.
