What to do after an accident that is not my fault in India?

I am having a question that who will be liable for the accident case caused due to sudden arrival of two wheeler from other side on the national highway without any license, helmet, and (even insurance papers might not be there I guess) and hit my car when I am driving around 80kmph on a National highway and got injured .I am having proper images that he came wrong because damage happened to right side of my car and I turned extreme left to avoid hitting of the two wheeler but he touched to my car and fell down and got head injury . His age is 70 years. The people related to him are arguing that its bigger vehicle fault , how it can be justified, the old man without having proper license and helmet just came from wrong side and fell down . Please provide me the proper solution.
