Yes, the SC/ST Act permits the granting of bail. The accused must appear before a court, either the High Court or a Special Court created for these kinds of crimes. Anticipatory bail is prohibited by Section 18 of the SC/ST statute, which means that an accused person cannot request bail under this statute in advance of being arrested. However, in Prathvi Raj Chauhan vs. Union of India (2020), the Supreme Court decided that in extraordinary circumstances, anticipatory bail could be granted in the absence of a prima facie case against the accused. The accused may request standard bail after being arrested. The court has the authority to grant or deny bail based on the seriousness and nature of the accusations. The accused may file an appeal with the High Court or Supreme Court.
