What can I do if someone files a false case against me?

My father has been fighting for his legally inherited property for over 10 years now. For over 2 years the opposite party is doing fake cases against him to get him. Today we got to know that a Harijan case has been filed over him in Jan 2023, that day he was in school (he is a teacher). The person who has filed the case is friend with the Judge and that's why even the bail is rejected, I really do not know what to do now.

Given your father's situation with the false cases filed against him, there are several steps he can take. First, he should gather evidence to prove his innocence, including documentation of his whereabouts on the dates in question. This can be crucial in court. Next, he can file a police complaint against those harassing him, detailing the false allegations and any threats made. Consulting with a lawyer specializing in property disputes and criminal law is essential for effective representation. If there is a conflict of interest with the judge, consider petitioning for a transfer to another judge or court to ensure a fair hearing.

If someone files a false case against you then you can file petition under section 482 of BNSS for Anticipatory Bail for quashing false allegations against you.

Sir, The applicant (you) may file petition the High Court as a matter of right if the Sessions Court denies the request for anticipatory bail. In the matter if the High Court denies the applicant's request for anticipatory bail, the applicant may file petition in the Supreme Court under Article 136 of the Indian Constitution as grounds for Special Leave Petition (SLP).
