How should I proceed with the stolen cheque and legal notices?

My relative gave me a cheque for 10 lakhs with his signature, but the bank was unable to process it and issued a return memo stating that the signature differs. I sent a legal notice to the person who gave me the cheque. In response, the opposite party sent me a legal notice claiming that he came to my house, stayed with the cheque in his suitcase, and that I stole it and put my signature on it. He is now suggesting that I file a police complaint for the stolen cheque. How should I proceed further?

Sir, if the person has accused you of theft and forgery, you can file a counter complaint with the police. If the cheque was issued to you for a legitimate transaction and the bank refused to process it due to the signature mismatch then you can still file a Section 138 case under the Negotiable Instruments Act, 1881. It is advised to consult an expert lawyer who will assist you in understanding your rights and options. For further legal assistance contact us on our helpline number
