Can the National Commission issue an arrest warrant for concealing information in appeal?
Appellant has concealed a High court case in appeal (wherein the authority of the consumer forum is established) and still questioning the legal authority of the commission in the Appeal. Does the National Commission have the authority to issue arrest warrant under IPC 199 and CP act for concealing the above information?
Under the authority granted by IPC Section 199 and the Consumer Protection Act, the National Commission is empowered to issue arrest warrants in case of concealing material information relevant to the case. Concealment of material facts can be viewed as an attempt to mislead the commission and would invoke contempt proceedings. The commission should uphold justice and transparency and, therefore, when the appellant fails to declare serious legal proceedings that have consequences on the merits of the case, it can take legal measures such as arresting warrants to ensure the respondent is complying with its orders and procedures.
NCDRC cannot directly issue an arrest warrant under Section 199 of IPC. It has the authority to penalize the appellant under Section 27 of CP Act. The perjury proceedings can be initiated under the Section 340 of CrPC. The case can be referred to the criminal courts for appropriate action such as issuing of warrant.
Sir, the National Commission doesn’t have the power to issue arrest warrants under IPC 199 or the Consumer Protection Act just for concealing information in an appeal. While the Commission can impose penalties or take action if a party hides important facts, issuing arrest warrants is beyond its authority.
