Can a criminal case be transferred to another party?

My uncle was shot in the hand when he was a minor by our neighbor. So as a elder brother my father filed a FIR against the neighbor. The neighbor was a army personnel at that time army came and bring that person with them. After 20 years the case has reopened and recall letter came to my father. But now my family relations has been shaken and it was not like before. So can I transfer the case from my father (Father -Neighbor) to my uncle (Uncle-Neighbor). Is it possible, please guide me. Thanks

Your father acted as guardian of minor. If he has no direct participation in the case or rights then he can delte his name from array of parties. However he maybe called as witness by the court. You can contact Lead India to know more in details or for the expert solutions, ensuring satisfaction through effective legal counsel and problem-solving.

Yes, it is possible to transfer a case from one person to another. The Transfer of Cases Act, 1956, governs the transfer of cases from one court to another, To transfer a case from your father to your uncle, you will need to file a petition with the court.
