Relaxation to present in court

My father filed an criminal case 12 years ago now recently we got summon for witness to present in the court. We have missed last two dates to present ourselves in court. My father is now 71 years old and a severe cardiac an diabetic patient and my mother is suffering from cancer. Can we seek two months time to appear before court stating treatment of my mother at Mumbai. Is that possible.

: Everyone who is summoned to witness in court is required to appear. However your father is sick and you are not able to attend and thus you have a valid grounds not to appear at the designated time.

you may be asked to provide documentation of your illness which you should show all the doctors certificate but you contact the court or the person who summoned you to appear at the court hearing as soon as possible.

If your father was sick if you failed to appear the court without notifying the court the court may imposes penalty then the court will decide if you are too sick to testify in court , you will usually be summoned to a new court if you have valid excuse for not appearing.
