What are my options if our farming land is illegally occupied by someone?
I have an empty land adjacent to it is my aunt's land. My aunt used to cultivate ragi in her land via third-person. For the first time in 2023 my aunt informed the third person to cultivate ragi in my land along with hers. We noticed it and enquired in the village and we went to third-party person and he said he was not aware and it was aunt who told him to cultivate. We then raised police complaint on both. Police raised NCR and in enquiry, the third-party person changed his statement that he just cultivated in aunt's land only and also aunt said that she was not aware whether that land is hers or mine orally to police but not writing in the statement. also during enquiry time the third-person harvested all ragi from my land also. police is not taking action on both third-person or my aunt. Can I convert NCR to FIR for both or anyone? This aunt has also created 3 other problems for us for which police is doing a separate check so we need to penalty for damaging my land troubling us.
Consult with a lawyer and seek legal advice. They can guide you on how to take legal action to protect your rights. File a complaint with the local police station against the person who forcibly occupied your land. You can also file a case in the court for trespassing and illegal construction.
Ma'am, In this case you need to draft a legal notice with the help of an expert lawyer which should be issued against them and also to the police station to take appropriate action against the person responsible. For further legal assistance contact us on our helpline number.
