Will anticipatory bail be granted in SC/ST FIR case?

An FIR has been filed under all the above-mentioned sections. What will happen to the accused person? Will he be granted anticipatory bail by the district court, considering he is innocent? Both the accused and the victim are mature and have known each other very well. What is likely to happen to the accused in this case? How can we defend the accused person?

The FIR is being filed under the SC/ST act and you will be able to get the anticipatory bail if the FIR fails to establish a proper case against the accused. In other words, if the FIR does not disclose sufficient evidence to prove the offence, then the accused will be able to get the anticipatory bail. In cases, wherein the FIR cannot be used against the complainant, an argument based on the personal relationship gone sour can be utilised based on the prior acquaintance of the accused and the complainant. However, the same cannot guarantee anticipatory bail as many other factors play a role in the same. If an FIR is filed under these sections, getting anticipatory bail may be difficult, especially due to SC/ST Act charges. But if both parties are mature and had a known relationship, the court may consider it. It is advised to consult an expert lawyer who will assist you to present proof of consent and innocence. Quick legal action and proper evidence can protect the accused. For further legal assistance contact us on our helpline number.
