Are maintenance orders appealable?

My ex wife is working with a PSU bank and our marriage lasted for 4 months only. She left my home on her own with her parents. She has won maintenance order worth 15k by family court. My lawyer is advising me to appeal the order in Bombay high court as the family court order is not tenable as she is govt employee and marriage was not consummated. Pls advise further course of action . Thanks

Your lawyer is correct in advising you to appeal the maintenance order in the Bombay High Court. There are a number of grounds on which the order can be challenged, including the fact that your ex-wife is a government employee and that the marriage was not consummated. Under Indian law, government employees are not entitled to maintenance from their ex-spouses unless they are unable to support themselves financially.
