Can Defendant file counter claim in guardianship case?

Sir, I am the respondent in GWOP petition filed by my spouse where she prayed for declaring her as the guardian for my children, I am planning to file counter to her petition with prayer to declare me as the guardian. Is my counter enough? Or to make court listen my prayers do I have to file counter claim? Please suggest.

Whether or not you need to file a counterclaim in order to make the court listen to your prayer to be declared the guardian of your children depends on the specific facts of your case. However, it is generally advisable to file a counterclaim if you want to seek any relief from the court. Contact us on our helpline number for further enquiry.
