Can interim maintenance be claimed under section 125 CrPC?
Wife asked 20,000 maintenance for herself and 20,000 for child in main Petition. In Interim she asked 24,000 only for child. Is her interim application maintainable in CrPC 125 Case because she didn't took court permission or informed court why she doesn't need relief in interim application

The Supreme Court of India has held in the case of Savita Bhan v. State of Maharashtra [(2012) 3 SCC 762] that the court is not required to give permission to the wife to file an interim application for maintenance for the child. The court also held that the wife is not required to inform the court why she does not need relief in the interim application. Contact us for further enquiry.
