How to legally deal with Domestic Violence and physical harassment?
We are separated from my father, staying in a different house now. He is harassing and doing harassment late at night around 1:30-2:00 am and he won't give divorce to my mother. He says if you don't be with me I will make your life hell and will harass me and my mother every day.
Your mother should lodge a complaint under the Protection of Women from Domestic Violence Act, 2005. She can seek protection orders, maintenance and residence rights. Document every incident of harassment and threats made by your father. If he threatens or harasses further, she can lodge a police complaint for criminal intimidation under Section 503 of the Indian Penal Code. On the other hand, you may also consider getting a restraining order, which bars that person from contacting you anymore.
Contact the police or a domestic violence hotline if you are in imminent danger. The National Helpline for Women (181) in India can help you connect with friends, relatives, or neighbours who can offer support. Either directly or with the assistance of a Protection Officer, you may file a domestic abuse complaint with the local Magistrate Court. Orders for immediate protection may be issued by the magistrate. Section 498A of the IPC, which addresses cruelty by a spouse or his family, allows you to submit a formal complaint at the local police station if you are being physically harassed.
Mam, if you and your mother are being harassed by your father then you should file a police complaint. You can also apply for a restraining order against your father with the help of an expert lawyer who will assist your mother to file a divorce on the grounds of cruelty.
