Validity of a marriage

Hello, I am asking this on behalf of one of my friends who got married about 30 years ago, but have not lived together for the last 10 years or so. Theirs was a Hindu marriage with the priest blessing the couple, the girl was barely 18 and the boy was 30. However, they have not registered their marriage in the marriage registrar's office. The husband was always abusive (physically, psychologically and sexually) towards the wife and very physically to the kids. The wife put up with everything for some years but then finally decided to go her own way with her children (who now are grown up). The question I am told to ask is: Is this marriage legal/valid in courts if so, Are there grounds for divorce based on the time spent apart or Are there any other grounds for divorce

Hello sir,

As both of them have not resided since 10 years, and also the male spouse is abusive towards her and her kids, she can file a petition for contested divorce as well as for restitution of conjugal rights and also demand for alimony from her husband, these will be mere grounds for the divorce between them.
