What happens if accused person does not appear in court?
I filed a case of 498a IPC on my husband, and after 2 months he filed a section 9 HMA case on me in which I appeared but he just threw full of allegations. Now my question is what happens if I don't appear in court for further proceedings, can he will be able to file any criminal case against me or my family, If I don't appear? Kindly suggest because I am unemployed and not financially able to go to the court, because it is 400km distance and no train or bus service is available, only have to go by car.
Respected Maam, Under Section 9 of the Hindu Marriage Act, if the opposite party (spouse) does not appear in court after a petition for restitution of conjugal rights is filed, the court may proceed ex-parte and issue a decree, requiring the absent spouse to comply with the court's order for restitution of conjugal rights. If you do not appear in court for further proceedings in your husband's Section 9 HMA case, the court may proceed ex parte. This means that the court may decide the case based on the evidence presented by your husband, without hearing your side of the story. Your husband may also file a motion to dismiss your 498A IPC case on the grounds that you have not been appearing in court. The court may grant this motion and dismiss your case.
