Court intervention in examination matters

If there is a wrong question in exams such that the error is sufficient to cause confusion/ambiguity in minds of students. Many students mailed about the error after the exam but no compensatory marks awarded by the exam conducting body. What can be done in this case? Can court direct the exam body to award marks?

If an exam question contains an error causing confusion and the conducting body does not award compensatory marks, students can take several actions. First, they should file a collective representation to the exam authority, detailing the error and requesting a review. If the authority fails to respond satisfactorily, students may consider filing a petition for judicial review in the High Court. While courts generally avoid interfering in examination matters, significant errors impacting performance may warrant intervention. Consulting a legal professional can provide tailored guidance on the best course of action based on specific circumstances and recent case law.

Sir, you might start by writing to the secretary of the relevant department as well as the Competitive Examination Board. You can file a writ against the Board to request directions if you don't receive a satisfactory or appropriate response to your questions. If they do not respond, you can submit a writ for the same claim and issue a legal notice through an expert advocate if you are personally impacted.  For further legal assistance contact us on our helpline number.
