What is the new regulation for assistant professor recruitment in UGC?
It is being alleged by the plaintiff that interview panel has acted in personal bias by selecting student from their own institute. At the time of interview plaintiff was itself humiliated by stating that private colleges are bad and being laughed at. Interview panel has adjudged against the principle of natural justice. In A.K Kraipak v. UOI(AIR 1970 SC 150) it was held that even a 'reasonable likelihood of bias' will be enough for violating the principle of natural justice. It is also reasonalble apprehension that professor will want their own college student to excel and thus be biased. Issues- whether is it valid to appoint a proffessor of same college in the interview panel for selecting candidate having student of same college? If doctrine of necessity allows then whether valid circumstances existed to not include a private college professor so that panel be more representative as not abridge fundamental right of the plaintiff according to Article 15,21 and 16?
