The foreigner can file a bail application in court under Section 437 of the CrPC if the offence is non bailable. She can provide grounds that she is married to Indian Citizen and her willingness to comply with immigration laws. Necessary documents have to be provided such as marriage certificate, proof of residence.

The foreign national will need to make an application to the court and provide the court with documentation to support their request. This documentation may include the foreign national's passport, visa, and marriage certificate. The foreign national may also need to provide evidence that they have strong ties to India, such as a job or property. For further Contact us on helpline number.
