Citizenship of India can be obtained by Descent under Section 4 of the Citizenship Act 1955. Under Section 5 of the CA 1955, citizenship can be obtained by Registration if one of the parents is Indian. You must hold a valid visa and stay in India legally for the required period. India and Nepal has entered into Indo-Nepal Treaty of Peace and Friendship, 1950 allows Nepalese citizens certain privileges, such as working and residing in India without requiring a visa. However, this treaty does not automatically confer Indian citizenship to Nepalese nationals. As an alternative Overseas Citizenship of India (OCI) card allows living, work and study in India without the need of Visa in case you are not eligible for full citizenship.

Children born to Indian parents outside India are eligible for Indian citizenship by descent under the Citizenship Act, 1955. However, this right applies only until the age of 18. For further contact us on helpline number.
