How can I stay in India if I marry an Indian?
I married my Vietnamese gf in India. what process should she follow to stay in India ?
The marriage has to be registered under Special Marriage Act 1954, if not registered in India yet. Apply for the Indian Spouse Visa by providing the proof of marriage and her valid passport, address proof in India. Within 14 days of her arrival on visa, she must register with Foreigners regional registration office (FRRO), if staying for more than 180 days.
If your spouse is of Vietnamese origin, she will need a suitable visa after marriage so that she can legalise in India also. If your wife is already on a tourist visa in India, the couple may apply for an extension or change the long-term status, such as a spouse visa. This would typically involve submitting an application to the Foreigners Regional Registration Office (FRRO) with the necessary documents, among them your marriage certificate, as well as her passport. If she is overseas, she can apply for a spouse visa at the Indian embassy in Vietnam that will permit her to stay in India legally.
Your Vietnamese spouse can apply for a spouse visa through the Indian embassy or consulate in Vietnam to stay with you in India.
