What is the eligibility for Indian Citizenship?
Hello, how are you? I am writing to you from the UAE. Legal query regarding my eligibility for Indian citizenship. I am a UAE citizen, born in 1996. I was born in the UAE to an Emirati father and an Indian mother. When I was born, my mother held Indian citizenship, but she renounced it due to naturalization with the UAE citizenship, at my father’s request. Currently for personal reasons I want to acquire Indian citizenship. I read the citizenship law which I understood as (If a person is born outside India to both or one of the parents being Indian citizens, the newborn shall be registered with the Indian Mission within one year of birth), but I was not registered because I am a legal dependent of my father in the UAE. Here I want to know the extent of my eligibility to obtain Indian citizenship, and is there a way for me to obtain it? As for the Indian documents from my mother's side, we only have a copy of her Indian passport as the only proof that she was Indian. Please help and answer my question. Thank you.
Indian citizenship can be obtained through decent under Section 6 of Citizenship Amendment Act 1955 (CAA) as your mother is Indian. Provide your mother passport as proof of her citizenship in India. Visit UAE embassy as you have not registered the birth and enquire about the procedures to be followed to get the Indian citizenship.
You may be eligible for Indian citizenship through descent since you were born to an Indian mother. Even though your mother renounced her Indian citizenship, you can apply for citizenship under Section 6 of the Citizenship Act, 1955. You will need to provide proof of your mother's Indian citizenship, such as her Indian passport copy. Since you weren't registered at birth, you should consult the Indian embassy in the UAE to understand the specific requirements and procedures for your application. They can guide you on obtaining citizenship based on your circumstances.
Sir, to determine your eligibility for Indian citizenship, you need to assess whether you meet the criteria for citizenship by birth, descent, or registration. If you are not eligible by these conditions you might have an option after 12 years of residency in India. It is advised to consult an expert lawyer of India who will assist you with the best course of action. For further legal assistance contact us on our helpline number.
