How can I get my grandparent's legal heir certificate from court?
I am from Chennai. My father was adopted son of my grandfather and grandmother. But adopted deed not done. I have my father school tc, marriage invitation, ration deletion certificate and my father death certificate. My father and their adopted parents no more. I got my father legal heir certificate. Also I need my grandmother and grandfather legal heir certificate? I couldn't able to apply legal heir certificate. Tahsildar told me try to get from court. Please advise me
In addition to the legal heir certificates, since your father was adopted without a deed, you might need to approach the court for a succession certificate. It declares you a lawful heir and would be necessary in case of the lack of legal documentation about your father's adoption. Engage a lawyer to advocate on your behalf in the court application and ensure all necessary documentation is provided, such as your father's legal heir certificate, his death certificate, and proof of your relationship with your grandparents.
The documents that you have such as marriage invitation, father death certificate, use them to establish the relationship. As Tahsildar suggested, approach the court for the succession certificate under Section 372 of Indian Succession Act, 1925.
Sir, since the tahsildar advised you to approach the court, file a petition for a Legal Heir Certificate in the Civil Court, providing documents like the death certificate, birth certificates, affidavits, and any other proof of relationship with the deceased. It is advised to consult an expert lawyer who will assist you with the best course of action. For further legal assistance contact us on our helpline number.
