What can I do if my bank account is freeze?
My father, brother and mine bank account has been hold by the SBI and HDFC bank. What should I do?
If your accounts in SBI and HDFC have been frozen, first of all, approach both the banks to know why your accounts were frozen. The investigating authorities can freeze accounts under Section 102 of the Criminal Procedure Code in case there is a suspicion of malfeasance. You can seek relief from the court against such an action. File an application under Sections 451 or 457 of the CrPC for de-freezing. This process normally takes 15 to 20 days. Consulting a lawyer may expedite the resolution and most importantly protect your rights as well.
First try to contact both the banks, SBI and HDFC, and ask them about the freeze. You have to cooperate with the investigations. If there is no valid justification for freezing your account, you can make a petition before the concerned magistrate court under sections 451 or 457 of CrPC for de-freezing your account. The court can compel you to execute a bond for the amount in issue. You can also seek advice from a lawyer to navigate the process effectively.
Sir, firstly you should contact your bank to get details about the account block, and also consult an expert lawyer regarding this issue who will assist you with the best course of action. For further legal assistance contact us on our helpline number.
