US Citizen Marriage With Indian National

I am an American citizen (born and raised in the United States of America) and my fiancé is an Indian citizen. I am a Christian and he is a Sikh. I understand that this union would fall under India's Special Marriage Act (SMA), however, I would like guidance on how to proceed with having a court marriage. For example, I would like to know what documents are needed? As well as, what are the steps to get our marriage registered?

The eligibility criteria are the same for foreigners as well as Indian citizens. The necessary documents required for a foreigner -

  1. Address & Resident Proof in India
  2. Passport
  3. Age Proof or, Birth Certificate
  4. VISA
  5. Marital Status Proof
  6. Court marriage takes around 30-40 days. But, the Marriage registration process takes only 2-3 Hours.
  7. No Objection Certificate from the embassy
  8. In case of a previous marriage, death certificate & divorce certificate

Special Marriage Act, 1954

This is an important act for the court marriage & marriage registration of both the partners irrespective of their caste & religion. No traditional marriage & rituals are performed during the marriage under this act.

It takes around 30 days for the completion of the marriage. All inter-religion marriages are performed under this act. The approval of parents is necessary for the marriages under the SMA, 1954.
