Can a Donor become a donee on behalf of a minor son?

I am 69 years old, a Muslim, want to make a gift Deed of a ownership flat in Mumbai to my minor son of ten years old and my wife with 80% & 20% resp. Please let me know if who can become the legal guardian of minor son? Father ( is donor also) or mother who is also a donee of 20% share? I have drafted Deed of gift document, can I send for amendment?

Both fathers and mothers can be legal guardians of their minor children in India. In your case, both you and your wife could be co-guardians. However, if you are unable to act as a guardian due to any reason, your wife would typically become the sole guardian. For further details contact us on our helpline number.
