Can I claim a property belonging to my unmarried step brother?
My mother had a second marriage. My mother expired in 2018.My father(my mother's second husband) expired in 2021.My step brother expired in 2022.My step brother had no other brother or sister except myself. My step brother's grand mother who expired in 2012 gifted her property in 2011 to my step brother who had made a joint venture with a property builder with that gifted property and got 2 flats. Now as my mother,my father(2nd husband) & my unmarried step brother expired so can I claim those 2 flats which is in my step brother's name?
As a sole surviving step son of dad, you're entitled to properties gifted by way of grandmother to step brother. post an application to Municipal Authority for mutation you name as proprietor in facts.
If Municipal Authority refuses, report a suit for announcement of your possession in civil court, the definition of “child” below clause 15B of section 2 of the income Tax Act, 1961. under this definition, “child” should suggest adopted baby or step-baby as well.
As according to the HSA, an applicant need to prove his succession, that is, he need to be a relative, Also as per your query there is no one left except you as the closest relative of his therefore that property belongs to you , you have the rights to hold the property of your deceased step brother.
